2. Your Developer Sues You For Breach of Contract Due to Defaulting on the Loan Balance or Maintenance Fees Under The Contract.

Many timeshare owners find themselves in a financial situation where they can no longer afford the loan payments or maintenance fees. In most cases, the timeshare owner will contact the timeshare's management company to "give back" their timeshare and take a loss of monies paid. There is a couple of challenges with that proposal. 

Timeshares are not tangible property. You are not "giving back" your "property," so the timeshare can "resell it" to someone else. That proposal holds if this was your home, you are defaulting on your mortgage payments, and the bank would foreclose on your home, keeping the equity and would sell it to a new buyer.

As you may know by now, you own an exclusive membership with a point system or week system, allowing you to use the developer's property once or twice a year, depending on the membership you purchased. For this reason, timeshare developers will not take back your timeshare with that proposal. Many owners feel the only solution is not to pay the loan or maintenance fee.
